Terms of Service

These Terms of Service ("Terms") govern your use of the IronQuest mobile application and related services ("Service"), operated by Samy Ouachek ("we", "us", "our").

By creating an account or using IronQuest, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

IronQuest is a fitness coaching application that uses AI to generate personalized workout programs, guides you through training sessions, and tracks your progress using an XP and rank system. The app is designed to work offline, with data syncing to our servers when connectivity is available.

2. Eligibility

You must be at least 16 years old to use IronQuest. By using the Service, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Account

You create an account using Apple Sign In or Google Sign In. You are responsible for all activity under your account. Each account is personal and may not be shared or transferred.

You may delete your account at any time from within the app. Upon deletion, your workout data, AI conversation history, and device registrations are permanently removed from our servers.

4. Subscriptions and Payments

Free trial

IronQuest offers a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription begins automatically.

Billing

Subscriptions are billed through the Apple App Store or Google Play Store. Pricing, billing cycles, and payment processing are governed by the respective store's terms. We do not handle payment details directly.

Cancellation

You can cancel your subscription at any time through your device's App Store or Google Play settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

Refunds

Refund requests are handled by Apple or Google according to their refund policies.

5. AI-Generated Content

IronQuest uses AI to generate workout programs and coaching responses. This content is provided for informational and general fitness guidance purposes only.

  • AI-generated programs are not medical advice. They do not replace consultation with a qualified healthcare professional, physiotherapist, or certified personal trainer.
  • We do not guarantee the accuracy, safety, or suitability of any AI-generated program for your individual circumstances.
  • You are solely responsible for assessing whether any exercise is appropriate for your fitness level and health condition.
  • If you have any medical condition, injury, or health concern, consult a doctor before using the Service.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the app
  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools, bots, or scripts to interact with the Service
  • Resell, redistribute, or commercially exploit any part of the Service

7. Intellectual Property

The IronQuest app, including its design, code, branding, and content, is owned by Samy Ouachek and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.

You retain ownership of your workout data (sessions, performance metrics, custom programs). By using the Service, you grant us a limited license to store, process, and sync this data solely to provide the Service to you.

8. Offline Functionality and Data Sync

IronQuest is designed to work offline. Workout data is stored locally on your device and syncs with our servers when an internet connection is available.

We are not responsible for data loss resulting from unsynced local data, device failure, or app deletion before sync completes. We recommend maintaining a regular internet connection to keep your data backed up.

9. Privacy

Your use of IronQuest is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that is harmful to other users or to us. We will make reasonable efforts to notify you before or at the time of termination.

You may stop using the Service and delete your account at any time.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

  • IronQuest is a fitness tool, not a medical service. It is not a substitute for professional medical advice, diagnosis, or treatment.
  • Physical exercise carries inherent risks. You participate in workouts at your own risk and assume full responsibility for any injury or harm that may result.
  • We do not guarantee uninterrupted, error-free, or secure operation of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Samy Ouachek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of France.

If you are an EU consumer, you also benefit from mandatory protections under the laws of your country of residence that cannot be overridden by this clause.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the date at the top of this page. Continued use of IronQuest after changes constitutes acceptance of the updated Terms.
